Who the Division Serves

People buying, selling or renting in an age-restricted community, retirees moving to Florida from another state, and the families helping them. When the move also means selling a home elsewhere in South Florida, the Residential Sales Division handles that sale and the two are planned together.

What Is Different About 55+ Communities

Under the federal Housing for Older Persons Act, a community can restrict residents by age when at least 80 percent of occupied units have a resident aged 55 or older and the community publishes and follows policies showing that intent. Each association then sets its own rules on who may live there, rentals, guests and pets, and most require an application and approval before closing. Fees, what they cover, the condition of the buildings and any planned assessments matter as much as the price.

How the Work Is Done

Buyers get a shortlist of communities matched to budget, lifestyle and health care, the association documents and rules read before an offer, and the application handled with the association. Owners selling in a 55+ community get pricing from sales in the same community and buyers who already meet its age and approval rules. Renters get the association's leasing rules and application handled before they commit.

Frequently Asked Questions

What is a 55+ community?
A community that restricts residents by age under the federal Housing for Older Persons Act: at least 80 percent of occupied units must have a resident aged 55 or older, and the community must publish and follow policies showing it is intended for older persons. The association's own documents set the details.
Can younger family members live with me?
It depends on the community. The law allows up to 20 percent of units without a resident aged 55 or older, and each association sets its own rules on younger residents, caregivers and guests. We read those rules with you before you make an offer.
Can I rent in a 55+ community first?
Often, yes, though many associations limit rentals, set a minimum lease term and require an application. Renting first is a good way to learn a community before you buy in it.
Can you sell my home and help me buy in a 55+ community at the same time?
Yes. The Residential Sales Division's Estate, Probate & Downsizing Department handles the sale of your current home, and the two are planned together: the timing of the sale and the purchase, the association approval, and the move in between.
