Estate, Probate & Downsizing Department
Estate, Probate & Downsizing Real Estate Services
Some sales come from a change in the household rather than the market: an estate, a trust, an inheritance, or a move from a larger home to a smaller one. The Estate, Probate & Downsizing Department works with personal representatives, trustees, heirs and owners, alongside the estate's attorney when there is one, to value, prepare, sell or lease the property properly and without unnecessary delay.
Part of the Residential Sales Division: the Estate, Probate & Downsizing Department.

Who Can Sell a Home in an Estate
In a Florida probate the court appoints a personal representative, whose letters of administration and the will (or the court) decide whether they can sell without further approval. A home held in a trust is sold by the trustee under the trust document, usually without probate. Heirs who inherit outright sell as owners. Which applies decides who signs the listing and the contract, so the estate's attorney confirms it first. This is a summary, not legal advice.
Homestead and the Family
Florida's homestead rules can restrict who inherits a home and whether it can be sold during probate, particularly when a spouse or minor child survives. Title companies will ask how homestead was resolved before they insure a sale, so raise it with the attorney at the start.
How the Department Helps With an Estate
A walk-through to see what the home needs and secure it; pricing from closed comparable sales, with the estate's appraisal where there is one; a plan for the contents, repairs and showings that works for heirs who may live far away; and a sale or lease run on the timeline the court and the attorney set. The department works for the estate, and everyone with a say gets the same information.
Downsizing to a Smaller Home
Not every move like this starts with an estate. Owners selling a larger home to move into something smaller, at any age, face many of the same decisions: what the home will sell for, what to keep, sell or give away, and how to time the sale with the next home. The department plans the sale and the move together, and brings in the right BreakThru department for the next home, whether that is a condo, a townhome, a 55+ community or a rental.

Frequently Asked Questions
- Does a probate home have to be sold as-is?
- No, but many are, because an estate may not want to spend money on repairs. We set out what the home would likely fetch as-is and after specific repairs so the personal representative can decide.
- How long does it take to sell a home in probate?
- The sale itself takes about as long as any other once the personal representative has authority to sell. The probate timeline, any court approval and resolving homestead usually take longer, which is why the attorney sets the schedule.
- Can an inherited home be rented instead of sold?
- Often, yes, if the personal representative or heirs agree. The Residential Leasing Division can lease or manage it while the family decides.
- Can you help me downsize?
- Yes. The department sells the larger home and plans it around the next one: whether to sell first or buy first, what the move costs, and the timing of both closings, with the buyer's side handled by the department that fits the home you are moving to.
- Do you buy estate homes?
- BreakThru Realty represents the estate in a sale. Where speed matters more than price, our cash offer option lets the estate compare a cash offer with a listing before choosing.
