Penthouse and Trophy Condominium Acquisition in South Florida

The building is the purchase: reserves, milestones, the board and the rules on your door

A penthouse buyer is buying a share of a building and a seat at its table, and the building can cost more than the unit. Florida now requires older coastal condominiums to complete milestone structural inspections and to fund reserves from a structural integrity reserve study, and the results of both sit in the association’s records waiting to be read. BreakThru Realty reads them first, then the approval process, the house rules and, for a tower not yet built, the contract and the escrow that hold the deposit.

Reading the Reserve Study and the Milestone Report

Under Florida law a condominium building of three stories or more that has reached a set age must have a milestone structural inspection by an engineer or architect, and associations must obtain a structural integrity reserve study and fund the reserves it calls for. Both, with the budget, the financial statements and the minutes, are records a buyer may request before closing. They say whether the building has a concrete problem, a roof problem or a money problem, and whether a special assessment is decided or merely coming. BreakThru Realty obtains the package, has an engineer read it when the findings are serious, and summarizes it before the inspection period ends.

Association Approval and the Interview

Nearly every luxury building in Sunny Isles Beach, Bal Harbour, Brickell, Miami Beach, Fisher Island and along the Fort Lauderdale and Boca Raton beaches screens its buyers. The application asks for identification, references, financial information and sometimes an interview with a committee, and the board meets on its own calendar. For a private buyer the questions are what the application reveals, who inside the building sees it, and whether the purchasing entity or its principal must appear. BreakThru Realty gets the form and the building’s rules on entity ownership before the offer, submits by secure link, and asks the manager how the file is stored and who has access to it.

Private Elevators, Lobbies and Service Entrances

Privacy in a tower is built into its circulation. A private elevator that opens into the residence, a separate service elevator and corridor for staff and deliveries, a staffed lobby that checks visitors against a list, and a garage with assigned spaces close to the elevator core all change what day-to-day life looks like. So do the sightlines from neighboring towers and from the beach into a glass-walled living room. Showings are used to walk these routes rather than to admire the finishes: how a guest arrives, how a delivery gets to the kitchen, how a resident leaves without crossing the lobby, and which rooms can be seen from where.

Rental Restrictions and the House Rules

The declaration and the rules decide what an owner may do with a residence, and they bind a buyer who never read them. Minimum lease terms, limits on how many times a year a unit may be leased, waiting periods after purchase, rules on pets and their size, restrictions on construction hours and on changes to flooring or plumbing, and the procedure for approving a renovation are all written down. A buyer who intends to lease the residence part of the year, to keep a large dog, or to combine two units needs the answer before the contract, not after. The documents are read in full during diligence, and the questions that matter are put to the manager in writing.

Pre-Construction Contracts and Escrowed Deposits

Buying a penthouse in a tower that does not yet exist means signing a developer’s contract, which is long, written by the developer and not negotiable in most of its terms. Florida law requires deposits to be held in escrow, and allows the developer to use the portion above a set threshold for construction once certain conditions are met, which the contract will spell out. The buyer’s attorney reviews the contract, the prospectus, the estimated budget and the completion deadline, and advises on what happens if the project is delayed or changed. If the balance at closing will be borrowed, consult a mortgage lender early, because a commitment cannot be issued years ahead of a completion date.

Assessments, Budgets and the Cost of Belonging

The monthly assessment is only part of what a residence costs to hold. The budget shows what the association collects for operations, what it puts into reserves, and whether the reserve funding keeps pace with the reserve study. The minutes show what the board is arguing about, whether a special assessment is being discussed for concrete restoration, a roof, elevators or the garage, and whether insurance has become a problem for the building as it has for many on the coast. The estoppel certificate issued before closing states what the seller owes and what is pending, and the buyer’s attorney reads it against the contract to decide who pays.

Closing and Taking Possession

Closing on a condominium adds the association’s approval letter to the usual title, survey and insurance requirements, and the move itself is scheduled through the building: elevator reservations, a certificate of insurance from the mover, and the building’s hours for deliveries. For a private buyer, BreakThru Realty handles the building side so the resident’s name is seen by as few people as possible, arranges for keys, fobs and garage access to be issued in the right name, and confirms that the unit’s cameras, smart locks and networks are reset to the buyer’s own accounts before anyone sleeps there.

Our Privacy Standard

A confidentiality agreement before the first conversation
Ask and a mutual non-disclosure agreement comes to you or your representative before any detail is shared, and it covers everyone at the brokerage who works on the file.
Your name stays out of our marketing
BreakThru Realty does not use a client’s name, likeness, team or transaction in its advertising, social media, website or press, before or after closing, unless the client asks for it in writing.

Questions We Are Asked

Which condominium records should a buyer read before the inspection period ends?
The declaration and bylaws, the current rules, the budget and reserve schedule, the most recent financial statements, the structural integrity reserve study, the milestone inspection report if the building is old enough to need one, the minutes from the past year, and the estoppel certificate. BreakThru Realty requests the full set at the start and has an engineer read the structural documents where the findings are serious.
Can a trust or a company own a penthouse in a South Florida building?
Usually, but the declaration decides, and some buildings require a natural person to be named as the occupant or to appear for the interview. The association’s rules on entity ownership are checked before the offer so that the buyer’s attorney can structure the purchase in a way the building will approve, rather than discovering a conflict during the application.
What happens to a pre-construction deposit if the project is delayed?
The contract governs. Florida law requires the deposit to be escrowed and sets conditions under which the developer may use part of it for construction, and the contract states the completion deadline and the buyer’s remedies if it is missed. The buyer’s attorney reviews those terms before signing, because they cannot be improved afterward.
Is a special assessment the buyer’s problem or the seller’s?
It depends on when it was adopted and what the contract says. Florida’s standard forms allocate assessments by the date the association approved them, and the estoppel certificate lists what has been levied. Reading the minutes shows what is being discussed but not yet voted, which is the part the contract may not cover and the negotiation should.
How does a buyer judge the privacy of a tower residence at a showing?
By walking the routes rather than the rooms: how the private elevator is called and where it opens, how staff and deliveries reach the residence, whether the lobby staff verify visitors, which neighboring towers and public beaches have a line of sight into the living areas, and how the garage connects to the elevator core. Those answers decide the privacy more than any finish.
