W Pompano Beach Ownership and Rental Rules: What You Can Do With What You Buy
Before the price, the rules: what you may do with a unit at W Pompano Beach is decided by the city condo hotel code, two condominium declarations, a master association and, for the suites, a rental program agreement. This page explains each in plain words, says which applies to which product and marks what we have confirmed and what we still read in the recorded documents before any client signs.

Hotel Suites and Private Residences, Side by Side
The two products are sold under one name and are not interchangeable. The hotel suite is a furnished unit in the hotel condominium whose owner use is capped by the city code; the private residence is a home in a second condominium with its own declaration and its own amenities.

The City Condo Hotel Code: 30 Days, 180 Days
Pompano Beach's zoning code for visitor accommodation uses sets the standards for a condo hotel. Lodging units may not be occupied by their owners for more than 30 consecutive days, nor for more than 180 days in total in any consecutive 12 month period, and the restriction must be included in the declaration of condominium. The code is the reason a hotel suite can never be a six month winter home, whatever a sales conversation suggests. It applies to the hotel suites; the private residences are not lodging units.

Two Condominiums, One Master Association
The developer describes a residential condominium association and a hotel condominium association, each part of a master association that charges its own fees. In practice that means a residence owner pays a residential assessment and a share of the master budget, a suite owner pays a hotel condominium assessment and a share of the master budget, and both pay separately for the beach club, the hotel amenities and the hotel services they use. The estimated budgets for each association are part of the offering documents, and we read the three budgets with you as one monthly figure.

The Rental Program
The hotel operator rents a suite as a hotel room when its owner is away and shares the revenue under the rental program agreement. The agreement sets the split, the charges the operator deducts for marketing, housekeeping and management, how an owner reserves their own stays within the 180 day cap, any blackout dates and how an owner leaves the program. The developer's disclaimer states that no offering is a securities offering and that statements about rental income, profit, appreciation or tax benefits should not be relied on; we read the agreement with you and never project income from it.

The Residential Declaration
The private residences are governed by their own declaration, which sets leasing terms, guest rules, pet rules and anything on occupancy. The developer presents the rental program with the suites and sells the residences as private homes; we have not yet read the recorded residential declaration, so this page does not state its leasing or occupancy terms. We obtain it and put the terms in writing for you before you sign, and we update this page when the documents are recorded.

Fees Beyond the Assessment
The developer says some amenities and hotel style services are available only at an additional cost and are not included with the purchase, and that beach club, hotel amenity and service fees come on top of the regular assessments. Expect valet, housekeeping, dining, the spa and the program's own charges to be billed as used. The fee schedule in the offering documents says which services are charged and how, and the listings on this page give the monthly fee each listing agent entered, which is an estimate until the associations are running.

Your Rights Under Florida Law
A buyer of a new condominium unit in Florida has 15 days after signing the contract and receiving the offering documents to cancel without penalty, and the developer must hold deposits in escrow, with amounts above 10% usable for construction only where the contract allows it. Those 15 days are when we read the declarations, the budgets, the rental program agreement and the delivery date with you, so you reserve with the rules in hand rather than discover them later. Schedule a private buyer consultation and we start with the documents that govern the product you are weighing.

Questions About the Rules
- How long can an owner stay in a W Pompano Beach hotel suite?
- No more than 30 consecutive days per stay and no more than 180 days in any consecutive 12 month period, under the City of Pompano Beach code for condo hotels, which requires the restriction in the declaration of condominium. The declaration and the rental program agreement can add reservation rules on top.
- Do the 180 day rules apply to the W Pompano Beach private residences?
- No. The city cap applies to lodging units, which are the hotel suites. The residences are governed by their own residential declaration, which we obtain and read with you before you sign.
- Does W Pompano Beach have a hotel rental program?
- Yes, for the hotel suites. The hotel operator rents a suite when its owner is away and shares the revenue under the rental program agreement, which sets the split, the charges and how you reserve your own stays. The developer says no statement about rental income should be relied on.
- What are the monthly costs of owning at W Pompano Beach?
- The assessment to your condominium association, your share of the master association, taxes, insurance and the fees for the hotel amenities and services you use, plus the rental program's charges for a suite. The developer's estimated budgets in the offering documents give the figures, and we put them on one page for you.
- Can I cancel a W Pompano Beach contract?
- Florida law gives the buyer of a new condominium unit 15 days after signing and receiving the offering documents to cancel without penalty. We read the documents with you inside that window.
