Buying W Pompano Beach From Another Country

Can a foreigner buy at W Pompano Beach? Yes, and most of the purchase works the same from Toronto, São Paulo, Bogotá, Buenos Aires, Mexico City, London, Paris or Frankfurt as from Florida. What differs is around the edges: one Florida law that reaches buyers from a short list of countries, the tax identification and the withholding when you sell, loans written for people without a United States credit file, and a closing you sign at home. This page covers those edges and the one choice international buyers face first: hotel suite or private residence.

Developer inventory: These are the units listed on the MLS today, hotel suites and private residences alike. A developer usually sells its own inventory directly from the sales gallery without listing each unit, so the developer's price list can hold layouts, floors and whole products this page does not show. Who May Buy

The United States sets no citizenship or residency condition on owning real estate, and a buyer abroad holds the same title as a buyer born in Pompano Beach. Florida restricts purchases of real property by people domiciled in China, and purchases near military installations and critical infrastructure by people tied to a few other countries, under chapter 692 of the Florida Statutes. A Florida attorney confirms whether the law reaches you before you sign, and the contract carries an affidavit about it. Owning a home gives no visa, and you need no visa to own one.

Suite or Residence, Seen From Abroad

An international owner who visits a few times a year for days or weeks fits the hotel suite: furnished, run by the hotel between visits, with owner use capped at 30 consecutive days and 180 days a year by the city code. An owner who wants the whole winter, or a home for family here, fits a private residence, with its own declaration and wider financing. Day counts matter in a second way for a buyer abroad: the United States substantial presence test counts days in the country for tax residency, and a tax adviser who works with nonresidents plans the calendar with you.

Taxes While You Own and When You Sell

Property tax applies to every owner, with no homestead exemption on a second home. Rental income from a suite in the program is United States source income and is reported here; a taxpayer identification number is needed for that and for the sale. When a foreign owner sells, the buyer generally withholds 15% of the amount realized under FIRPTA and sends it to the IRS, and the actual tax is settled on a United States return. Estate tax reaches United States property owned by nonresidents at a far lower threshold than for citizens, which is why many foreign buyers hold through an entity planned with a tax adviser before they buy, not after.

Paying for It From Abroad

Many international buyers pay cash, partly because the developer's deposits are due in cash during construction regardless of any loan. Those who borrow use foreign national loans, underwritten from income and assets documented at home with a larger down payment, and for a hotel suite the lender must also accept a condo hotel unit, which narrows the field. Money crosses the border through a United States bank account the title company and the developer's escrow agent accept, planned weeks ahead. Consult a mortgage lender before you reserve.

Closing From Home

The registration, the price list, the contract and the deposits can be handled from abroad, and the closing documents can be signed where you live before a notary or at a United States consulate, with a Florida attorney and the title company arranging it. Most buyers still want to see the sales gallery before they reserve; we arrange the visit and go with you, and we present by video call when you cannot travel. In Spanish, directly; in Portuguese and French, with an interpreter we arrange.

Where the Offering Is Not Directed

The developer's disclaimer says the offering is not intended for residents of New York or of any jurisdiction where it is prohibited, and each country has its own rules on how a foreign property may be advertised to its residents. We do not market the project where the developer's offering does not reach; we answer the questions of a buyer who comes to us. Our country guides for Canada, Brazil, Colombia and Argentina cover the questions those buyers ask most.
