Buying a Home in Florida With a Tenant in Place
La respuesta breve
Yes. A sale does not end a lease: the buyer takes the property subject to it and becomes the landlord. Read the lease before you sign a contract, get the tenant's written confirmation of its terms and deposit, and make sure the lease fits your plan, because you cannot move in until it ends.
You Inherit the Lease
The lease continues with you as landlord on its existing terms: the rent, the end date, renewal rights and who maintains what. A month to month tenancy can be ended with written notice under Florida law; a fixed term lease generally runs to its end unless it says otherwise. Read it, and ask your attorney what it allows.
The Tenant Estoppel
Ask the seller for a signed estoppel letter from the tenant confirming the rent, the deposit held, the lease end date, any prepaid rent and any claims against the landlord. It protects you from surprises the seller did not know or did not mention.
Security Deposit and Rent at Closing
Florida law requires the seller to transfer the tenant's security deposit and advance rent to the buyer at closing, or otherwise account for them. Rent for the month of closing is prorated on the settlement statement.
Financing With a Tenant
Loans for an owner occupied home usually require you to move in within a set period after closing. If the lease runs longer, you may need an investment property loan instead, with different terms. Consult a mortgage lender before you sign.
Access and Condition
Inspections and showings require notice to the tenant, and you may not see every room before the contract. Build access for the inspection into the contract, and check the condition carefully, because move out repairs become your problem.

Selling a Rental or Small Multifamily Property?
Investors buying duplexes, triplexes and rented homes ask for the rent roll, the leases, the expenses and the condition, and several have told BreakThru Realty what they want to buy. If you own an income property, a broker can compare it with those requirements and explain how a sale with the tenants in place would work.
BreakThru Realty works with hundreds of prequalified buyers searching for properties. Before you list, a broker reviews what you own, the market around it and whether an existing buyer's requirements match. If none does, you see how we would position it to reach other qualified buyers.

A potential match is a conversation, not an offer, until the buyer sees your property and makes one. No buyer is named and nothing about your property or business is shared until you decide to proceed.
Buying a Home in Florida With a Tenant in Place: Questions
- Can I buy a house in Florida that has a tenant living in it?
- Yes. A sale does not end a lease: the buyer takes the property subject to it and becomes the landlord. Read the lease before you sign a contract, get the tenant's written confirmation of its terms and deposit, and make sure the lease fits your plan, because you cannot move in until it ends.
- Can I evict a tenant after buying the house?
- Not just because the property sold. The lease continues; a month to month tenancy can be ended with proper notice, and a fixed term lease generally runs to its end. Ask a Florida attorney before you rely on ending it.
- Who gets the tenant's security deposit when a rented home is sold?
- The buyer, as the new landlord. Florida law requires the deposit and advance rent to be transferred or accounted for at closing.
- Can I get a regular mortgage on a home with a tenant?
- An owner occupied loan requires you to move in within a set time, which a lease may prevent. An investment property loan may fit instead; consult a mortgage lender.
